Please read this End-User License Agreement ("Agreement") carefully before downloading, installing, or using Lumina Timelapse Studio, provided by Ludovic Devulder

By purchasing a license key, downloading, or using the Software, you agree to be bound by the terms of this Agreement :

1. License Grant :

Subject to the terms of this Agreement, Licensor grants you a non-exclusive, non-transferable, and revocable license to install and use the Software on the number of personal devices specified at the time of purchase (typically up to two machines per license key for single-user use).

2. License Activation & Verification :

The Software utilizes an automated license verification system. To activate your license, the Software collects a cryptographically hashed hardware identifier (HWID) and communicates with our verification servers via secure HTTPS connection. You agree not to manipulate, bypass, or interfere with this verification mechanism.

3. Restrictions :

You agree not to, and you will not permit others to:* Decompile, reverse engineer, disassemble, or attempt to derive the source code of the Software.* Modify, adapt, translate, or create derivative works based on the Software.* Sell, rent, lease, sublicense, distribute, or publicly host license keys or cracked versions of the Software.* Use the Software for any unlawful purpose or in violation of any applicable regulations.

4. Intellectual Property :

All intellectual property rights, trademarks, copyrights, and trade secrets related to Lumina Timelapse Studio remain the exclusive property of Ludovic Devulder. This Agreement grants a license to use the Software, not an ownership transfer.

5. Disclaimer of Warranty :

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. LICENSOR DOES NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, UNINTERRUPTED, OR COMPATIBLE WITH ALL HARDWARE CONFIGURATIONS

6. Limitation of Liability :

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF DATA, REVENUE, OR MEDIA FILES) ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE SOFTWARE. LICENSOR'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE SOFTWARE LICENSE.

7. Governing Law & Jurisdiction :

This Agreement shall be governed by and construed in accordance with the laws of France and the European Union. Any dispute arising out of this Agreement shall be submitted to the competent courts.

Privacy Policy

Ludovic Devulder operates the website https://luminatimelapsestudio.com and the Lumina Timelapse Studio desktop application. We are committed to protecting your personal data in accordance with the General Data Protection Regulation (EU) 2016/679 (GDPR).

2. Data We Collect  :

A. Order & Payment Processing : Name, email address, billing address, IP address.
Purpose : Processing software orders, invoice generation, and delivering license keys.
Legal Basis :  Performance of a contract (Art. 6(1)(b) GDPR).
Payment Processor: Payments are securely processed via Stripe. We do not store or process credit card details on our servers.

B. Software License Activation : License key, hashed Hardware ID (HWID), activation timestamp, operating system version.
Purpose : Validating activation limits and preventing unauthorized license distribution.
Legal Basis: Performance of a contract and Legitimate interest in preventing piracy (Art. 6(1)(f) GDPR).

C. Support Inquiries : Email address, message history, technical log files submitted voluntarily.
Purpose: Providing customer support and troubleshooting.

3. Data Storage and Security :

All server-side database records are stored on secure servers located within the European Union (OVHcloud, France). We implement strict technical safeguards, including HTTPS/TLS encryption and Ed25519 digital signatures.

4. Data Retention :

Billing data: Retained for the statutory duration required by tax and commercial regulations (up to 10 years).
License activation data: Retained for the active lifetime of your license.
Support queries: Retained for up to 3 years after the last contact.

5. Your Rights Under GDPR :

You have the following rights regarding your personal data:
Right of access: Request a copy of your personal data.
Right to rectification: Request correction of inaccurate data.
Right to erasure ("Right to be forgotten"): Request deletion of data when no longer legally required.
Right to lodge a complaint: You have the right to lodge a complaint with a supervisory authority (e.g., CNIL in France - www.cnil.fr).To exercise any of these rights, contact us at devulder.l@gmail.com.

Refund Policy

At Lumina Timelapse Studio, we want to ensure you have a seamless experience.  Please read our refund terms regarding digital products and software licenses :

1. Try Before You Buy (Free Version) :

Because video rendering performance is heavily dependent on hardware (GPU, CPU, RAM) and operating system configurations, we offer a free download version of Lumina Timelapse Studio. We strongly recommend testing the software on your system before purchasing a Pro license key.

2. Legal Policy :

EU Right of Withdrawal for Digital Content In accordance with European Union consumer law (Directive 2011/83/EU on Consumer Rights) and Article L.221-28 of the French Consumer Code: The statutory 14-day right of withdrawal does **not apply** to digital content supplied immediately upon purchase once the download has begun or the license key has been delivered and activated, provided the consumer gave prior express consent and acknowledged the loss of the right of withdrawal.

3. Technical Defect Exception :

If you experience a critical technical issue that makes the Software unusable on your system:
1. Contact our support team at devulder.l@gmail.com within **14 days of purchase.
2. Provide your system specifications and a description of the issue so we can attempt to provide a fix or workaround.
3. If we are unable to resolve a genuine, reproducible bug preventing core functionality, we will issue a full refund at our discretion.

4. Non-Refundable Circumstances Refunds will not be granted for: 

Change of mind after activating the Pro license key.
Failure to check system requirements prior to purchase.
Purchases made on unauthorized third-party platforms.
